Affidavits, Letters & Power of Attorney & School Documents

Affidavit is word that hails directly from the Latin meaning “to pledge their faith under knowledge of the law”. It is a document or declaration under oath indicating the contents are true. Advanced Mobile Notary & Apostille has employees who are commissioned by the state of California as a Notary Public to witness the signing of the document and notarize with the official state seal of California. All of or our notary publics are registered and commissioned with the state of California Secretary of State.

Documents submitted to Advanced Mobile Notary & Apostille for signature authentication and must be notarized by a California Notary Public.

Most common notarized documents are Power of Attorney documents, Heath Care Directives and Affidavits and other documents requiring your signature.

Customers requiring authentication of any school records (e.g., transcript or diploma) must obtain a notarized copy of the record from the high school, university, etc. before submitting the documents for Apostille or Authentication. Do not make the mistake to notarize your own diploma or school transcript. The receiving school or University will usually reject the document for they want the Dean of records from the school or university to Notarized the document.

Power of Attorney

A Power of Attorney document gives the “power” or right of someone else to make legal decions on your behalf. That person is called an “agent” or “attorney-in-fact.” By establishing a durable power of attorney this person or “agent” may have the power to act on your behalf for some, but not limited to the following:

  • To act as a corporate officer or agent
  • Make financial decisions for you (including writing checks, withdrawing money from bank)
  • Purchase or sell real estate
  • To pursue legal action on your behalf
  • To pursue Insurance claims on your behalf

For the Power of Attorney to be valid, you must present yourself, in person, to a California notary public. You will need to provide a valid government-issued ID, and sign the document in front of the notary. The notary will then “notarize” the document. Note, if the document does not have notary certificate, please request from the notary that he or she uses a “California All-Purpose Certificate of Acknowledgement.” Please examine the “Acknowledgement” form. In order for this form to be valid, it must have the following verbage:

“I certify under PENALTY OF PERJURY under the the laws of the state of California that the foregoing paragraph is true and correct”

Older “California All-Purpose Certificate of Acknowledgement” forms lack the “penalty of perjury” phrase, and are not valid.
